We have published our new book, Divorce and the Family Business. The book is an invaluable resource for professional advisors who are supporting clients through an often difficult and challenging time.
When there is a family business involved, divorce can have a big impact on how the business will continue to operate, and the goal for all involved is to limit this impact as much as possible.
With over 50 years of experience in family law between them, authors Nick Stone and Roger Bamber have put together an exhaustive book that will help all involved to ensure that any family business comes through the process of divorce with as little upheaval as possible.
Nick, who is head of the national family law team, specialises in complex family business, farm and trust cases and is co-author, with William Barr, of Divorce and the Farm. Roger has co-authored the book The Family through Divorce with Dr Josse and Dr Reinstein and has over 30 years experience of dealing with the complicated business, pension and trust issues that have to be negotiated when a marriage ends.
Divorce and the Family Business covers all the potential flash points when dealing with divorce and business ties. The book includes chapters on business structure, the treatment of business assets on divorce, valuing stock options and deferred shares, liquidity and security, tax implications and the out of court options, including mediation and arbitration.
Nick said “When dealing with what is a very distressing time, many people find the added complication of a family business very difficult to cope with during divorce. All parties want the best for their family and business but often complex legal details can make this a confusing and time consuming process.
“At Mills & Reeve we help many clients who are dealing with the end of their marriage and know how important it is to ensure that, legally at least, it is as stress free an experience as possible. With business and personal feelings closely entwined, clear and accurate advice is essential.”
Roger adds “Family businesses are complicated and emotions can run very high. By combining our experience, Nick and I have published a book that hopefully takes the mystery out of the process and gives an indication of what to expect at each stage. We always aim to get the best possible solution for our clients and their businesses when guiding them through divorce proceedings, and our book should help provide a solid foundation to help others do this too.”
The book will be officially launched in November.
