What can I do for you?

I am a partner in our healthcare and regulatory team. I help organisations through very difficult times, often following serious incidents and accidents in the workplace where there has been a fatality. I can support you through police and health and safety investigations and all manner of regulatory prosecutions.

The period immediately after a serious incident can be one of the most challenging periods that you and your organisation will face. I can support you as you navigate the maze of parallel processes that flow from the death of, or serious injury to, an employee or client. I can ensure that you protect yourselves while at the same time working with regulators in a co-operative and beneficial way.

Supporting my clients’ objectives

I make sure that I am available and responsive to my clients. When the worst happens I appreciate that you need immediate support on site. You need practical and effective advice that recognises the difficulties that you face.

On many occasions I have been able to ensure that clients take charge of difficult situations and ensure that they are not exposing themselves unnecessarily to enforcement action. This can involve liaising directly with the police and HSE, attending emergency board meetings and preparing staff ahead of interviews.

With the introduction of the Corporate Manslaughter and Corporate Homicide Act 2007 it is even more important for clients to ensure that their risk management processes are smart, robust and effective. Together with clients I have worked proactively to help them ensure that their procedures reflect best practice and are effective.

What do others say?

It is important to me that the advice and support that I provide really makes a difference to the people involved. This means that I help make it all a little easier for them by giving them a clearer idea of what is going to happen, helping them understand what is important and what steps they need to take. It means a great deal when clients tell you that you have achieved this. One client wrote in to say:

“I wanted to let you know what a first class service we have had from Duncan Astill. This is at every level in the organisation. You will be aware of the very unfortunate case he has been dealing with, but he has managed to support me as the Chief Exec right through to the staff who were called to give witness statements. We still have some work to do with the HSE, but the support he has given us has been excellent.”

What else should you know?

I belong to the Health and Safety Lawyers Association and am a specialist member of the Institute of Risk Management, which helps me keep up to date with developments in the field. I believe passionately in improving patient safety in the NHS and regularly help clients to develop and improve their risk management structures and lecture on the subject.
