Regulatory enforcement – health and social care

Your challenges

As a statutory regulator committed to improving standards of care and protecting service users, any enforcement action you take will need to be carefully considered.

Achieving your ambitions

Our specialist team can support you in deciding upon the most appropriate enforcement action and in then ensuring that the action has a successful outcome. We have extensive experience of enforcement under the Care Standards Act 2000 and have provided in-house advocacy on emergency applications and prosecutions as well as appearing in hearings before the First Tier Tribunal. We have also provided national training seminars on enforcement for regulatory inspectors and managers.

The strength you need

Our specialist team has acted for the regulator of social care services since the creation of the national regulator in 2002. Our work has included a number of successful prosecutions of unregistered services and of registered services for breach of regulations. We have provided advice and representation for emergency applications and for tribunal appeals in relation to cancellation of registration and imposition of conditions. We have also represented the regulator in successfully defending a number of appeals to the High Court.

Lawyers you can trust

The Legal 500 directory describes the regulatory team as “’responsive, practical and client focussed’ providing ‘good, clear, robust advice’”. Feedback received indicates that the support we provide and our knowledge and understanding of the sector is greatly valued.
