Mental health

Your challenges

Mental health law is difficult and challenging and that is just the lawyers!

Mental health professionals have recently faced many legislative changes. We have delivered training on the Mental Capacity Act 2005, amendments to the Mental Health Act (MHA) and on Deprivation of Liberty Safeguards to ensure that trust staff have understood the implications and impact of these changes. This training continues to be available to you.

Achieving your ambitions

Whatever your mental health law requirements, we can help. We understand that you need to provide patient care in a complex and demanding environment.

Our experience will be used for your benefit. We advise on interpretation of the amended Mental Health Act. We provide support/representation at inquests and tribunals. We work with clients to facilitate treatment of patients, such as those with eating disorders. We ensure you receive timely, pre-emptive advice to avoid litigation but, if judicial review proceedings are issued, we will robustly defend your position.

The strength you need

You will have a team of two partners and eight lawyers to help you deal with the complex world of mental health law. You’ll also have access to a range of specialists in, for example, healthcare and public law to ensure that you receive a complete service. Clients that we’ve helped include Nottinghamshire Healthcare NHS Trust and Norfolk and Waveney Mental Health NHS Foundation Trust.  Our large healthcare law team allows us to draw on expertise in best interests cases, child law and incidents and investigations.

Lawyers you can trust

Our mental health team is highly rated by Chambers UK. We are described as “combining personalised service with great depths of resources”. Our clients have described us as “absolutely excellent”, “extremely responsive” and “analytical with a high level of expertise”.

Legal 500 has said: "Jill Mason's team is the top choice for health: whatever you need, they will be able to help" and "the response times are remarkable and the acumen and knowledge excellent."

We recently hosted a Mental Health Symposium at the Kings Fund entitled Mental Health - 2012 and Beyond. To find out more, visit our Health Broadcast Centre, which contains video commentary from our key note speakers and delegates.
