Summary:
In December 2008, the House of Lords laid down a two stage test to establish the nature and scope of a public body's obligation to its patients under Article 2 of the European Convention of Human Rights. The case was referred to trial and was heard in March of this year by the High Court. The Court ordered the Defendant Trust to pay damages to the deceased's daughter for "just satisfaction".
