In this bitesize session, James Thompson and Rachael Hendry will look at the first English judgment on the ‘Duty of Fair Presentation’ under the Insurance Act 2015 (Berkshire Assets (West London) Limited v AXA Insurance UK plc). This case considers:

  • What will constitute a ‘material’ fact?
  • What is a moral hazard?
  • The test for inducement; and
  • The importance of factual and expert underwriting evidence.
