Helping you to manage your information objectives

Paper records, electronic documents, emails, texts, websites, closed mailing lists, social media – the digital revolution has brought with it a massive flow of data that needs to be appropriately managed.

Information law, data protection and privacy go to the very core of professional and personal interests, involving a delicate balancing act of competing rights and obligations. Organisations must ensure that they comply with a wide range of legislation and regulatory guidance.

We can help guide you through the maze to help you achieve your information objectives and, where appropriate, minimise the risk of you breaching your obligations. We are experienced in advising on the full spectrum of information law, data protection and privacy issues, including:

  • Proactive audits of compliance and best practice under legislation such as the Freedom of Information Act 2000, the Environmental Information Regulations 2004 and the Data Protection Act 1998
  • Defending your interests before the Information Commissioner and the Information Tribunals (both at the First Tier Tribunal and subsequent Upper Tribunal stages).

Increasingly, we are assisting our clients to "forward plan" their operations in a manner which will comply with the General Data Protection Regulation, which on taking effect in May 2018 will substantially amend the existing data protection legislative framework.

Our specialist lawyers have developed a deep understanding of your sector, so we understand the critical nature of managing and using your information – and that of others – effectively.

Our experience

We have years of experience advising on information matters. So, no matter how novel the issue you have, it is very likely we have considered it before, and we will know how to address it. Recent examples of our experience include:

  • Assisting public sector clients in dealing with complex requests for information relating to confidential and commercially sensitive material, including complaints to the Information Commissioner’s Office.
  • Advising education sector clients on appeals before the Information Tribunals in relation to the Freedom of Information Act 2000 and the Environmental Information Regulations 2004 on a range of subject matters, including requests for pre-publication academic research, access to course materials and employee salary disclosure.
  • Representing an NHS trust client in Information Tribunal proceedings relating to access to deceased family members’ personal data, in which the trust’s position was upheld by the Tribunal.
  • Providing detailed, strategic risk management advice on a range of sensitive data security breaches to address the issues with minimal disruption to the clients' operations and manage staff communication and relations.
  • Advising a range of clients on data sharing activities, including proposed transfers outside of the EEA, which requires additional considerations under the Data Protection Act 1998.
  • Providing on site, data protection audit services to clients to ensure that their information systems comply with legislation.
  • Advising on a range of privacy matters, including the use of CCTV on clients’ premises and “privacy notices” under the Data Protection Act 1998.
