Update: Liberty Protection Safeguards Code of Practice consultation

The Government has confirmed that it plans to start a public consultation in the new year on the Code of Practice for the new Liberty Protection Safeguards.

In a question in the House of Lords, Baroness Barker asked when consultation on the Code of Practice will commence. Baroness Blackwood’s response explains that since the Mental Capacity (Amendment) Act 2019 received Royal Assent in May, the Department of Health and Social Care has been engaging with a range of stakeholders to co-produce the new Code and the plan is to start a public consultation in the new year. The Code will be then be laid before both House ahead of the new LPS scheme coming into force. This accords with what we understand to be the general position and that the consultation would start in January 2020.
