Helping you through the financial distress of restructuring and insolvency

We have deep sector knowledge that we bring to bear in assisting distressed businesses in the real estate, technologyfood and health sectors.

We advise companies, creditors and lenders on solvent re-organisations and restructuring, as well as all aspects of credit, legal, insolvency and counterparty risk. We also advise insolvency practitioners and banks in connection with formal insolvency processes, such as administration, provisional liquidation, receivership and liquidation.

If you need to go to court, we can help. We have extensive experience of dispute resolution and litigation in an insolvency context, prosecuting a large number of claims on behalf of liquidators for issues including misfeasance, breach of fiduciary duty, transactions defrauding creditors, wrongful trading and fraudulent trading. At any one time, we will usually be pursuing more than 40 “live” cases.

A senior member of our team has extensive experience of advising HMRC in relation to VAT frauds such as “carousel” frauds and excise duty frauds, as well as advising the Official Receiver on disqualification proceedings..

We are extremely active in developing asset recovery strategies with insolvency practitioners for the benefit of creditors, usually working on a conditional fee basis.

Our experience

We have considerable experience helping clients with restructuring and insolvency issues, including: 

  • Advising the administrators of Silver Spring Soft Drinks Limited, which was one of the UK’s largest independent manufacturer of soft drinks, on trading, security issues, sales of plant and machinery, and contractual issues with suppliers and customers, such as major supermarkets. 
  • Advising the administrators of the Brilliant Media Group (previously the UK’s largest independent media agency with a turnover of £143 million) on the sale of the business to Mediacom (part of WPP). 
  • Advising the administrators of Biotica Technology Limited on the sale of the technology and intellectual property rights for Biotica products, including Biotica’s unique compound for the treatment of Hepatitis C, which affects 5 per cent of the world’s population. 
  • Advising Duff & Phelps as administrators of Axminster Carpets Limited. 
  • Working on a successful conclusion in the Court of Appeal in Bramston v Haut (2012).
