NEC4 amendments

Last week saw the announcement of a set of amendments to the NEC4 suite of contracts.  These amendments follow those issued in January 2019 and October 2020.

The main amendments to the Engineering Construction Contract (ECC) are:

  • Adjudication - changes to dispute resolution Option W2 in respect of the  procedure and timetable for adjudication

  • Climate Change – Option X29.  This was issued in July 2022 (see Carla Parsons’ blog on this) but has now been incorporated into the ECC

  • Early Contractor Involvement . Secondary Option X22 has been amended

  • Schedule of Cost Components and Short Schedule of Cost Components to address people working from home

  • Using the supplier’s design. This has been clarified and extended to include documents prepared for design

What is perhaps surprising is that there are no amendments to address the Corporate Insolvency and Governance Act 2020 or the Building Safety Act 2022
