Inquests and the application of Article 2

The Divisional Court, which included the Chief Coroner have recently considered an important case involving the application of Article 2 of the European Convention on Human Rights and the scope of the positive operational and the enhanced investigative Article 2 duties in R (Morahan) v Assistant Coroner for West London.

Morahan is an interesting judgment for inquest practitioners and as Bridget Dolan QC of Serjeants’ Inn neatly puts it, is now the latest  “cut out and keep” judgment for anyone wishing to get up to speed on the current state of the law with regard to Article 2.
