Update No. 3: coronavirus guidance for Mental Health Tribunal hearings

Although it may feel like many moons ago, you may remember our updates last year in relation to the Mental Health Pilot Practice Direction. We saw a change to practice, with face to face hearings defaulting to telephone hearings, rule 34 assessments changing to remote assessments where practicable and consideration of applications being determined on the papers.

Following an initial extension of the pilot to 18 March 2021, we can confirm that the Senior President of the Tribunal has now agreed to extend it to 18 September 2021. You can see the updated terms here.
