Building Safety: Building Safety Levy - government responds to the consultation

On 23 January 2024 the government issues its response to the building safety levy consultation

The levy is expected to apply to the development of residential and mixed-use buildings of any height. 

Points to note in the response in terms of the government's intentions are:

  1. The consequences of non-payment of the levy will be the withholding of a completion certificate or the rejection of final certification.
  2. The levy will be charged on a per square metre basis
  3.  There will be differential geographic levy rates.
  4. Brownfield sites will be charged at 50%
  5. Exemptions: Developments of less than 10 units will be exempt. Developments of purpose-built student housing of fewer than 30 bed spaces will also be exempt. Affordable housing, non-social homes built by not-for profit registered providers, NHS hospitals, medical homes and GP practices, supported housing, children’s homes, domestic abuse facilities, criminal justice  accommodation, accommodation for armed forces and care homes and nursing homes will all be exempt.
