JCT Design and Build 2016

JCT has announced that the JCT Design and Build 2016 form of contract will be despatched to those that have pre-ordered, on 22 September 2016.

JCT have given an indication of what the new form will include. The changes are perhaps more wide ranging than had generally been anticipated and will include:

• Incorporation of the JCT Public Sector Supplement 2011 relating to Fair Payment, Transparency & BIM.
• Adjustments to reflect the Construction (Design & Management) Regulations 2015 and the Public Contract Regulations 2015.
• Changes to the works and existing structures insurance provisions
• Amendments to payment provisions namely
  • Establishing (for Fair Payment purposes) Interim Valuation Dates that apply to main contract, sub-contract and sub –subcontract levels.
  • Increasing the flexibility of fluctuation provisions.
  • Consolidating notice requirements of the Housing Grants, Construction & Regeneration Act 1996.
• The Inclusion of provision for Performance Bonds and Parent Company Guarantees
• Changes to Collateral Warranties and Third Party Rights
