The Data (Use and Access) Bill

We have recently published a summary briefing of the main provisions in the Data (Use and Access) Bill.  The Bill includes changes to data protection law intended to support the research, archiving and statistics (RAS) purposes in UK GDPR, as well as new obligations in relation to complaints-handling.  Other data protection measures are mainly intended to make certain lower-risk processing activities easier, including in relation to some automated decision-making.

The Information Commissioner will also be replaced with an Information Commission, and there are some recent Government amendments to reduce regulation of marketing email communications sent by charities for their charitable purposes.

The Bill includes a number of other measures, mainly intended to support the Starmer Government’s growth agenda on topics including:

  • Smart data
  • Digital verification
  • Trust services
  • Cookies and other PECR requirements
  • Online safety
  • Information standards in the health and adult social care system
  • Delivery of public services to organisations
  • National underground asset register
  • Register of births and deaths
