Following the handing down of the highly anticipated Supreme Court's judgment in URS Corporation Ltd v BDW Trading Ltd on 21 May, our next Breaking Ground will examine the court's decision in this key case, which confirms the position in relation to a number of key areas:

• The approach to claims in negligence where the loss was voluntarily incurred

• The interplay between different causes of action and the retrospective extension of limitation periods by the Building Safety Act 2022

• When the entitlement to pursue a claim for contribution under section 1 of the Civil Liability (Contribution) Act 1978 arises 

• Whether the scope the Defective Premises Act extends to developers or if it is restricted to those with an interest in the dwelling
