As we approach the sixth anniversary of the onset of the Covid-19 pandemic, the limitation period for claims against brokers in relation to insurance policies which did not respond to business interruption losses in the way that policyholders may have hoped will either be approaching or, in many cases, have already passed. They discussed how the courts will approach cases where a broker has failed to put cover in place and the court is asked to assess the likelihood that hypothetical cover would have been available if the broker had done its job.
