In our April edition of The Box, James Thompson and Shaira Begum consider the Court of Appeal’s approach to causation in Norman Hay Plc v Marsh Ltd in claims against insurance brokers. They discussed how the courts will approach cases where a broker has failed to put cover in place and the court is asked to assess the likelihood that hypothetical cover would have been available if the broker had done its job.
