Arbitrators not subject to anti-discrimination legislation

The Supreme Court has overturned a decision of the Court of Appeal in relation to the appointment of arbitrators. Arbitrators are not counted as 'employees' for the purposes of anti-discrimination legislation.  As a result, the anti-discrimination laws do not apply to the selection of arbitrators.
