The new Construction Act introduces the concept of a specified person who can serve both a payment notice or a pay less notice on behalf of the payer.
The specified person can be "determined in accordance with the contract".
Architects,contract administrators ,quantity surveyors and employer's representatives watch out. Under the new JCT standard form of building contract, all of you can give the pay less notice, so logic dictates that you must all be a specified person.
And if you fail to give a pay less notice, when one should have been served? Well, you may be negligent.
