Goodbye DoLs hello Liberty Protection Safeguards

The Mental Capacity (Amendment) Bill has finished its bumpy journey with the last stage in the House of Lords on 24 April and is now awaiting Royal Assent. The intention is that it will come into force in spring 2020.

For those of you who have been following the Bill’s progress you can read the debate that took place in the House of Lords on 24 April, including observations from Baroness Murphy about the abandonment of any statutory definition of deprivation of liberty. Alex Ruck Keene's commentary on the Bill is worth a read – if only to bring you up to speed as to how we have arrived at our end point.

We will be updating readers further as soon as we have more details of the timescales through to implementation.
