Court of Protection visitor reports: OPG issues new guidance

The Office of the Public Guardian has published guidance on Court of Protection visitors and the circumstances under which their reports can be released. The guidance clarifies that these visitors report independently to both the Public Guardian and the Court of Protection. They help in the supervision of deputies and investigating concerns about deputies or attorneys.

The guidance outlines the five specific situations in which reports may be released:

  • to interviewees;
  • to parties involved in court applications;
  •  to the police or local authorities involved in an investigation;
  • in response to subject access requests under the Data Protection Act; or
  • with the court’s permission, if it ordered the report
