Proprietary estoppel

Proprietary estoppel is a legal principle that prevents someone from going back on a promise relating to property if another person has relied on that promise to their detriment.  

Examples of when proprietary estoppel could arise:

  • Working on a family farm in return for a low wage after being promised that you will inherit the farmland
  • Moving into a property to provide care after being promised that you will inherit the property in return  
  • Spending time and money renovating a property after being promised that you will inherit the property in return
